Angela Brown, mother of fifteen year old, Trey, is facing two years in jail and $6,000 in fines in Madison, Minnesota. She is being charged with child endangerment and possession of a controlled illegal substance. She was offered a plea deal, but has chosen to take the case to trial instead. She wants to be tried as a good mom who was helping her son, rather than accept an unjust plea deal.
She is facing these charges for giving her son medical cannabis oil to treat his debilitating medical condition. Trey suffered a brain injury when he was struck in the head with a baseball about three years ago. Since the brain injury, Trey suffers from chronic pain, headaches, and muscle spasms, and has even had a seizure. These are all symptoms often treated with medical cannabis in states where the plant is legal for medical use. He has been prescribed many different pharmaceutical pills to treat his conditions of the years. According to the Browns, none of the pharmaceuticals have helped. Nothing has helped until medical cannabis oil, which halted Trey’s muscle spasms and pain within one hour of the first consumption.
It is wild to think that this mother is facing jail time in Minnesota for something that families in other states do openly without prosecution. This case is especially sensitive since Minnesota recently passed a medical marijuana law that would allow qualifying patients to use medical marijuana oils and edibles to treat debilitating conditions. Unfortunately for Angela, this law does not go into effect until 2015.
Angela, with the support of her family, has chosen to fight the charges all the way to the courtroom. Her choice between breaking the law to help her son, or following the law and leaving him to suffer, is a tough one.
