The medical marijuana program in Canada is on trial this week, as patients are fighting the new laws that were adopted by the federal government in April 2014. The new program run by Health Canada, known as the Marihuana for Medical Purposes Regulations (MMPR), eliminates the patients’ right to cultivate, and forces them to register with a government-licensed producer.

The idea behind this shift in policy revolves around preventing criminal operations from distributing untested and potentially unsafe cannabis to patients on the illicit market. The government may not have realized that this change would put some patients in a tough position.

In March 2014, just before the new MMPR rules were enacted, a temporary injunction was granted to allow patients to continue growing until this case could be heard in court. The patients who filed it cited many reasons including how the cost may become too expensive for many patients to afford to purchase from commercial growers, and that being forced to switch to a different strain may not treat their condition as effectively.

While growing their own may be important to some, that is not the case for all. Not all patients have the time and resources to cultivate their own medicine.
